Ben Johnson DLA Piper

Ben is a Partner specialising in all contentious, risk advisory and documentation aspects of Payment Systems including merchant acquiring, cards issuing and card schemes.

 

 

With experience founded in banking litigation, his practice is broad, providing advice to UK clearing banks on such card issuing matters as: marketing contract arrangements, the implementation of new card scheme programmes, and new card technologies; and such merchant acquiring matters as: merchant acquiring regulation throughout Europe; streamlining of merchant acquiring documentation and management of acquiring and issuing bank's interests in card data breaches.

He speaks regularly to UK clearing banks on these topics.

Notable projects include:

1.         Advising the payment processing and card issuing sections of a major retail bank on the impact of the Payment Services Directive.

2.         Advising a major retail bank in connection with contactless cards programmes.

3.         Advising a major UK card acquirer following the world’s largest compromise of card data at a major merchant.  Involved advising on contract liability, potential adverse publicity and the fine regimes of the major card schemes.

 

4.         Providing advice to merchant acquirers and issuers on documentation review projects with particular emphasis on stress testing key risk and collection clauses

The talk will cover the legal aspects of recent fraud trends, including topical fraud and how best to manage it. I'll present on a couple of recent fraud types and the issues arising.
